Data Protection Information for the processing of personal data in the context of application processing

Thank you very much for your interest in a job offer from the companies of the DRÄXLMAIER Group (hereinafter referred to as "DRÄXLMAIER Group") which are affiliated under group law. The DRÄXLMAIER Group attaches great importance to the protection of your personal data (hereinafter "Data").
Please note that this data protection information also applies if you register with our e-recruiting applicant portal via social media portals. It is expressly pointed out that the data protection regulations of the social media portals are not applicable to the DRÄXLMAIER Group E-Recruiting. For applications by internal employees the company data protection regulations shall also apply.

On the following pages we would like to inform you about how your data is processed and what rights you are entitled to in connection with your personal data.

I. Definitions
This data protection information of the DRÄXLMAIER Group uses the terms which are used in the basic data protection regulation (DSGVO). The terms are defined in Art. 4 DSGVO, among others. The following terms are used in this data protection information:

Personal data:
any information relating to an identified or identifiable natural person ("data subject"); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person

Processing:
any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organisation, organisation, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction

Restriction of processing:
the marking of stored personal data with a view to limiting their processing in the future

Pseudonymisation:
the processing of personal data in such a way that the personal data cannot be related to a specific data subject without additional information, provided that this additional information is kept separately and is subject to technical and organisational measures which ensure that the personal data is not related to an identified or identifiable natural person;

Person responsible:
the natural or legal person, public authority, agency or any other body which alone or jointly with others determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or national law, the controller or the specific criteria for his or her designation may be laid down by Union or national law

Processor:
A natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller;

Recipient:
Any natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not that person is a third party. 2However, authorities which may receive personal data in the course of a specific investigation carried out pursuant to Union law or the law of the Member States shall not be considered as recipients; the processing of such data by those authorities shall be carried out in accordance with the applicable data protection provisions and in accordance with the purposes of the processing;

Third parties:
any natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or the processor, are authorized to process the personal data;

Consent:
to the data subject any freely given specific, informed and unequivocal indication of his or her wishes in the form of a declaration or other unequivocal affirmative act by which the data subject signifies his or her consent to the processing of personal data relating to him or her;

III. collection and processing of personal data
The following categories of personal data are collected by us and come from the following data sources:

Furthermore, we would like to point out that the data you provide may be used to create statistics and evaluations about the application process. This data is created in anonymous form exclusively for our own purposes, if necessary with the support of a service provider.

IV. Purpose of data processing and legal basis
We only process your data if we have either received your consent to process the data or if the processing is permitted by law.

The legal basis is your consent in accordance with Art. 6 para. 1 a DSGVO by activating the check box in the e-recruiting applicant portal or your written consent. Further legal basis is in individual cases the fulfilment of a contract or the implementation of pre-contractual measures according to Art. 6 1 b DSGVO

V. Recipient of the data or category of recipients
We process your data confidentially, within our responsibility only those departments and employees who need access to your data to fulfil the above-mentioned purposes are granted access.
This also means that data will only be transferred to third parties if this is necessary and legally permitted for the above-mentioned purposes or if you have given your prior consent.

VI. transfer to third countries
The data may be transferred to the following third countries, if this is necessary within the framework of the specific application process or if you have given your consent for your data to be stored in the Talent Pool. In this context, it must be ensured that the following third countries have an appropriate level of data protection. This is provided as follows:

An adequate level of data protection is ensured by the EU standard contractual clauses.

Hint:
Your data will not be stored by us outside the European Economic Area. However, access from a country outside the European Economic Area is possible by way of administrative access, as the operability of the systems is often ensured according to the follow-the-sun principle. In such cases, data is only accessed if either the Commission has issued an adequacy finding for the country in question, we have agreed the standard contractual clauses provided by the EU Commission for such cases with the service providers, or the company in question has drawn up its own internally binding data protection regulations which have been recognised by the data protection supervisory authorities

VII. Data protection of minors
Participation of minors under the age of 16 in the application process requires the express written consent of their legal guardians; this declaration of consent must be enclosed with the application documents.

VIII. storage period

The DRÄXLMAIER Group stores personal data for as long as it is necessary for the above-mentioned purposes and/or for the statutory storage obligations or until all mutual claims have been fulfilled. If the purpose on which the collection is based has been fulfilled, the data will be regularly deleted, unless it is necessary to process them further for a limited period. This means that - unless there are special cases (see note under the following table) - we will delete your data as follows:

If you have expressly agreed in writing, storage of your data in the DRÄXLMAIER Group Talentpool. Your data can then be checked for vacancies in all German affiliated companies of the DRÄXLMAIER Group and processed for this purpose: 12 months

*The deletion of certain data is not carried out in individual cases, if e.g. the German Commercial Code, the Fiscal Code, the Money Laundering Act stipulate longer retention periods, if legal limitation periods of up to 30 years make it necessary to retain certain data for the preservation of evidence or if further storage is required due to valid legal regulations or judicial orders.

IX. Your rights as a data subject
In relation to the processing of personal data you are entitled to the following rights:

According to Art. 21 para. 2 and DSGVO, you can object at any time without restriction to processing for the purposes of direct advertising.
If the data are processed on the basis of legitimate interests (Art. 6 para. 1 f) DSGVO or for the performance of a task in the public interest, you have the right to object to the processing in accordance with Art. 21 para. 1 DSGVO.
In this case, the data will no longer be processed for this purpose, unless compelling reasons for processing worthy of protection can be demonstrated which outweigh your interests, rights and freedoms or the processing serves to assert, exercise or defend legal claims.
You have the right to revoke at any time any consent granted under Art. 6 para. 1 a) DSGVO
If you are of the opinion that the processing of personal data violates applicable law, you may, in accordance with Art. 77 DSGVO, lodge a complaint with the competent data protection supervisory authority at any time
This right shall apply independently of any other administrative or judicial remedy.

X. Provision requirements or obligations
You only need to provide us with the personal data that we need for the conclusion, implementation and termination of the contractual relationship or the specific purpose or that we are required to collect by law. If you do not provide us with this data, we will have to refuse to conclude the contract or will no longer be able to perform the contract.

XI. Automated decision making
We would like to point out that an automated decision making process is not carried out by us.

If the e-recruiting applicant portal is used via the DRÄXLMAIER Group homepage, the general data protection information stored here also applies.

XIII. Amendment clause
As our data processing is subject to changes, this data protection notice will also be adapted from time to time. We will inform you about changes in good time. Here you will also find the current status of the data protection regulations.

Otherwise, any existing local data protection regulations in other countries take precedence.
XIV Information about your right of objection according to Art. 21 DSGVO

a) Right of objection on a case-by-case basis:
You have the right to object at any time, for reasons arising from your particular situation, to the processing of personal data relating to you which is carried out on the basis of Art. 6 para. 1 e DSGVO (data processing in the public interest) and Art. 6 para. 1 f DSGVO (data processing based on a balancing of interests); this also applies to profiling within the meaning of Art. 4 No. 4 DSGVO based on these provisions.
In this case, in the event of an objection, we will no longer process your personal data, unless we can prove compelling legitimate reasons for processing which outweigh your interests, rights and freedoms or the processing serves to assert, exercise or defend legal claims.

b) Right to object to the processing of data for direct marketing purposes
In individual cases, we process your personal data in order to carry out direct advertising. You have the right to object at any time to the processing of personal data concerning you for the purpose of such direct marketing, including profiling, insofar as it is connected with such direct marketing.
If you object to processing for the purpose of direct marketing, your personal data will no longer be processed for those purposes.
